Customer information and Terms and Conditions for the United Kingdom and Overseas

 

1. Scope of application

This customer information and these General Terms and Conditions shall apply to all orders placed through the website www.Evaniy.com (the "Website"), if the invoice is to be sent to an address in the United Kingdom. Placing an order with Evaniy indicates your acceptance of these terms and conditions.
Changes to these General Terms and Conditions will only be effective if they are confirmed by Evaniy in writing. This also applies to any changes to this written form clause.

 

2. Conclusion of a purchase agreement

Any orders made by you on the Website constitute a binding offer to conclude a purchase agreement with Evaniy Online. The binding purchase agreement only comes into existence when Evaniy accepts your order either on the website or by sending you an email or written communication, or by dispatching the goods ordered.

The goods and price information on the Website is subject to change without notice. You will be charged the price displayed on the Website at the time of your order.

 

3. Reservation of performance in case of goods not being available

If goods you ordered are not available within thirty days of your order, Evaniy can withdraw from the purchase agreement even if it has confirmed acceptance of your order. If the company withdraws from the purchase agreement, it will immediately inform you of this and will immediately refund the amount already paid by you for these goods.

 

4. Price and additional costs

The total amount of your order, including all taxes and additional costs such as packaging and delivery, is displayed on the screen prior to, or at the end of, the checkout process.

 

5. Delivery and reservation of title

The goods will be delivered to the delivery address as stated by you and through a delivery service appointed by Evaniy. The company will make every effort to deliver the goods as soon as possible, for UK usually within 5-7 working days, for Overseas 7 - 10 working days,, but this cannot be guaranteed. The goods remain Evaniy property until full payment is received.

 

6. We offer a Standard delivery service within the UK & Ireland only:

Delivery should take from 5-7 working days from the date of collection, however outlying areas such as the Highlands & Islands of Scotland, the Isle of Man, Isle of Wight and Channel Islands may take slightly longer. Please allow 10 working days from the date of order before querying a delivery. (Please note: Promotion products might take up to 10 working days within the UK, outlying areas might take up to 15 working days)

 

Approx. Dispatch Time

All 'In Stock' orders that are received by Snow Paw before 2pm GMT will be dispatched the very next working day. Delivery times vary depending on where the goods are being sent to and the type of service that has been selected. For UK please allow 5 - 7 working days for delivery. For Overseas please allow 7 - 10 working days for delivery.

 

Return policy

Evaniy wants you to be completely satisfied with your purchase. If you are not happy with your product for any reason, it can be returned for a refund or an exchange. 
You have up to 30 days after purchase to return your products, however we insist that the products must be returned unused and have their label still attached attached.

 

The best way to send my returned goods back

When returning any goods to us, we recommend that you send using a recorded method of delivery and that you keep proof of posting, as we cannot be held responsible for packages that fail to reach us. Please check with the post office that your parcel is adequately insured against loss or damage. If you are returning an item from overseas, please ensure that the postage is paid in full and the postal docket is ticked as ‘Returned Goods’ to avoid an import duty levy from HM Customs & Revenue, for which we will not be liable.

If my goods arrive damaged, faulty or incorrect

If you receive damaged, faulty or incorrect items, please contact us so that we can send you a pre-paid returns label for the UK, for Overseas please contact us and we will reimburse the postage charges. We will do our utmost to resolve the issue quickly and with as little inconvenience to you as possible. We will be happy to exchange the item for a replacement within 30 days from the date of dispatch. If you would prefer a refund, then the value of damaged, faulty or incorrect goods will be refunded in full, including your postage costs. For products that develop a fault after 30 days please contact us.

 

Do I have to pay for postage if I want to return or exchange an item?

No, you have 30 days from the date of purchase to return or exchange an item with the UK. You can create a Tracked returns label via Royal Mail using the following link: http://www.royalmail.com/track-my-return/create/316. For Overseas customers must cover the return postage, unless faulty.

 

Lost In Transit

Evaniy will deem an item lost in transit once 15 working days or 20 working days for any Continental European orders (not including weekends) have passed following dispatch (in line with Royal Mail policy). If your item has been lost in transit, do not worry, we will stand by our commitment to you by either replacing the item(s) lost, or refunding your payment, whichever suits your individual circumstances. We require confirmation in writing that the items have been lost.

 

8. Right to cancel the purchase agreement

As a consumer, you have the right to cancel this purchase agreement up to 14 days after receipt of the goods by you. If you exercise this right of withdrawal, you are no longer bound to the agreement and Evaniy will refund any payments you have made with respect to this agreement. You can obtain further information and assistance regarding Evaniy’s return policy. In order to cancel the agreement, it is sufficient to send a notice in writing, Evaniy customer service will provide the return address for your to send the products back. We do recommend all customers send their goods back within 14 days after you receive the return address information. Evaniy do not take any responsibility for any products get lost or damaged before our team receiving them back. And our quality control department will exam the condition of the products and packaging before we issue and refund or exchange.

 

9. Warranty

The warranty period is 30 days after the receipt of the goods by you. Should the delivered goods prove defective within this period, you may cancel the purchase agreement or, if the product is still available, make a request a product’s replacement by giving Evaniy notice at the address specified in paragraph two. No independent guarantee is granted beyond the foregoing. The rights of the consumers based on the consumer protection laws in force are not affected.

 

10. Liability

Evaniy is not liable for any damage, unless such damage has been caused by intent or by gross negligence. In no event shall Evaniy be liable for indirect damage.

If Evaniy, notwithstanding the foregoing, be liable for damage, then liability will be limited to the purchase price.

The above liability limitations apply to all claims for damages no matter what the legal grounds may be, inclusive of tortuous acts; they do not apply to potential liability according to the regulations on product liability. The rights of the consumers based on the consumer protection laws in force are not affected.

The exclusion or the limitation of the liability for damages according to the above paragraphs also applies to potential claims against employees or authorized representatives of Evaniy.

 

11. Prohibition of assignment

You may assign your contractual rights to a third party only with Evaniy Online's prior written consent.

 

12. Applicable law

The agreements concluded under the inclusion of these General Terms and Conditions are subject to the laws of the United Kingdom under the exclusion of a possible reference to foreign law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
